Terms of Service

The agreement between you and us for using Axis. The parts that matter most are near the top: what Axis is, what it is not, and who is responsible for what.

1.This agreement

These terms are between you and [LEGAL NAME] trading as Axis (ABN [ABN]) — "we", "us", "Axis". By creating an account or using Axis, you accept them. If you do not accept them, do not use Axis.

To use Axis you must be at least 18 and resident in Australia. If you use Axis on behalf of a trust, self-managed super fund, company or another person, you confirm you are authorised to bind them, and these terms apply to them as well as to you.

Our Privacy Policy forms part of this agreement.

2.What Axis is, and what it is not

Axis is a record-keeping, calculation and scenario-modelling tool. It performs calculations on data you enter, against settings you choose, and presents the result back to you.

Axis does not give advice. Nothing in Axis is financial product advice, credit assistance, tax advice or legal advice, and nothing in it is a recommendation to buy, sell, refinance, borrow, or enter into any credit contract or financial product. We do not hold an Australian Financial Services Licence or an Australian Credit Licence, and we do not act as your adviser, broker or credit assistance provider.

Specifically, and because these are the outputs people are most likely to misread:

  • Health verdict, runway, reserve floor and LVR ceiling describe your position against thresholds you set in Axis. They are not lender criteria and no lender is bound by them.
  • Available via refinance and Needs revaluation are arithmetic on the valuations and loan balances you recorded, up to an LVR ceiling you chose. They are not an offer of finance, an assessment of what you can borrow, or a statement that any lender will lend it.
  • Borrowing capacity is whatever figure your broker or lender gave you and you typed in. We neither assess nor verify it.
  • Capital gains figures are indicative estimates. They are not tax advice, they do not account for your full circumstances, and they are not a substitute for your accountant.
  • A plan being "valid" means only that the scenario satisfies the constraints you configured. It does not mean finance will be approved, that the strategy suits you, or that any projected outcome will occur.
  • Missions and rankings are prompts about what may be worth attention, generated from your own data. They are not instructions and not advice.

Property investment carries real risk, including the loss of money. Before you act on anything you see in Axis, get advice from a licensed financial adviser, credit assistance provider, accountant or solicitor who knows your circumstances. Every decision you make is yours.

3.Your data, your inputs

Axis calculates on what you give it. Its output is only ever as accurate and as current as your inputs. You are responsible for the accuracy and currency of the balances, valuations, rates, rents, dates and assumptions you record.

Axis flags staleness — freshness indicators, confirmation missions, amber validity — as a convenience to help you notice drift. Those flags are a prompt, not a guarantee that everything unflagged is correct.

4.You own your data

Your portfolio records, your documents and your plans are yours. We claim no ownership of them and no rights over them beyond what is needed to operate the service for you — storing them, processing them, backing them up, and showing them to the people you share them with.

You can ask for a copy of your data at any time, and we will supply it as a structured data file with your original documents. Email privacy@axishq.com.au; the timeframes are set out in the Privacy Policy. If you close your account we delete your data as described there.

We may use aggregated, de-identified information about how Axis is used to operate and improve it. That never includes anything that identifies you, your properties or your finances.

5.Your account and the people on it

  • Keep your sign-in secure and let us know promptly if you think someone else has access.
  • You can invite others to your account — a partner, an accountant, a mentor. You are responsible for what people you invite do in your account, and for removing them when they no longer need access.
  • Advisers you share with get read-only access to the parts you select. You control the scope, and you can revoke access at any time.
  • If you connect Axis to an external AI tool, you are responsible for that connection and for whatever that tool does with what it reads. Revoke it when you no longer want it.
  • A subscription covers one household or portfolio. It is not for sharing across unrelated portfolios.

6.Information about other people

Axis lets you record details about people who are not Axis users — tenants, brokers, agents, conveyancers, accountants and tradespeople.

You confirm that you are entitled to record that information and to give it to us to handle on your behalf, and that doing so does not breach anyone else’s rights or any agreement you are under. We handle it only to provide the service to you, as described in the Privacy Policy.

7.Acceptable use

Use Axis lawfully and sensibly. Do not:

  • Scrape, crawl or bulk-extract from Axis by any means other than the interfaces we provide.
  • Resell, sublicense or redistribute Axis or the data you get out of it as a service to others.
  • Upload anything you do not have the right to upload, or anything unlawful or malicious.
  • Attempt to access another account, probe or test our security without our written permission, or interfere with the service.
  • Reverse engineer or copy the software, except where the law says you may.
  • Use Axis to provide licensed financial, credit or tax advice to third parties while representing that Axis backs it.

8.Our intellectual property

We own Axis — the software, the interface, the calculations, the documentation and the brand. You get a personal, non-exclusive, non-transferable right to use it while your account is open and these terms are met. Nothing here transfers any of our intellectual property to you.

If you send us feedback or suggestions, we may use them to improve Axis without any obligation or payment to you. You keep any rights you already had in them.

9.Availability and support

We do not offer a service level agreement or an uptime guarantee. Axis may be unavailable for maintenance, for upgrades, or because something has gone wrong. We aim to keep it running and to restore it promptly, and we will give notice of planned maintenance where we reasonably can.

Support is provided on a reasonable-endeavours basis by email at support@axishq.com.au and through the feedback tool in the app.

We may change, add or remove features. Where a change materially reduces the service, we will give you reasonable notice.

10.Beta terms

Axis is currently in beta. While it is, these terms apply and prevail over anything inconsistent elsewhere in this agreement:

  • Axis is provided as is. It will have defects, gaps and rough edges.
  • There is no fee. The subscription terms below describe what will apply when paid subscriptions begin, and take effect only once we have given you notice and you have chosen to subscribe.
  • Features may change or be removed at short notice.
  • We may need to reset or migrate data. We will give you notice and an opportunity to export first, except where an urgent fix makes that impossible.
  • Keep your own records. During beta, do not rely on Axis as your only copy of anything that matters.

We will tell you when beta ends and these terms stop applying.

11.Subscriptions and billing

This section takes effect when paid subscriptions begin. It does not apply during beta.

  • Subscriptions are billed in advance, monthly or annually, in Australian dollars. Prices shown include GST unless stated otherwise.
  • Subscriptions renew automatically for the same period until you cancel.
  • You can cancel at any time from your account settings or by emailing us. Cancellation takes effect at the end of the period you have paid for, and you keep access until then.
  • We may change prices with at least 30 days notice before the change applies to your next renewal. If you do not accept the new price, cancel before it takes effect.
  • Where we offer a founding rate, it stays fixed against later price rises for as long as your subscription remains continuously active. It does not survive a cancellation.
  • Beyond your rights under the Australian Consumer Law described below, we do not refund part-periods.

12.Liability

Your rights under the Australian Consumer Law. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract. Nothing in this agreement excludes, restricts or modifies those guarantees or any other right you have under the law that cannot be excluded.

Subject to that, and to the extent the law permits:

  • We are not liable for investment, financing, tax or property decisions you make, or for their outcomes. That follows from what Axis is: a calculator over your own figures, not an adviser.
  • We are not liable for loss caused by inaccurate, incomplete or out-of-date information you entered, or by your failure to keep it current.
  • We are not liable for indirect or consequential loss, or for loss of profits, revenue, opportunity, anticipated savings, goodwill or data, however it arises.
  • Where our liability can be limited, it is limited at our option to resupplying the service or paying the cost of having it resupplied.
  • Our total liability to you for all claims in any 12-month period is capped at the fees you paid us in the 12 months before the claim arose. During beta, when no fees are payable, that cap is nil — which is the trade for a free, as-is service, and is precisely why you should not rely on Axis as your only record.

Each of these limits is separate. If one is found unenforceable, the rest still apply.

13.Ending this agreement

  • You can stop using Axis and close your account at any time. Export your data first — ask us and we will send it.
  • We may suspend or close your account if you breach these terms. Except where the breach is serious or unlawful, we will tell you what the problem is and give you a reasonable chance to fix it first.
  • We may withdraw the service entirely, with at least 60 days notice and an opportunity to export your data.
  • When the agreement ends, your right to use Axis ends. Your data is handled as set out in the Privacy Policy. The sections on your data ownership, our intellectual property, liability and governing law survive.

14.Changes to these terms

We may update these terms. For material changes we will email you at least 30 days before they take effect. If you keep using Axis after that, you accept the updated terms; if you do not accept them, cancel before they take effect. The version and date at the top of this page always show what is current.

15.Governing law

This agreement is governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that hear appeals from them.

If something has gone wrong, email support@axishq.com.au first. Most things are quicker to fix than to litigate.
